1. Introduction
These Terms of Service govern your access to and use of the Business Setup AE website, tools and services (the "Platform"). Please read them carefully before using the Platform.
Business Setup AE operates an online marketplace where entrepreneurs can compare business setup packages published by independent third-party providers operating in the United Arab Emirates, and request quotations from them.
2. Definitions
- "Business Setup AE", "we", "us" — the operator of the Platform.
- "Provider" — an independent third-party company formation firm, consultancy or corporate service provider whose packages appear on the Platform.
- "Package" or "Listing" — a set of services, inclusions and pricing information attributed to a Provider.
- "User", "you" — any person accessing the Platform or submitting a quote request.
- "Quote Request" — an enquiry you submit asking to be connected with one or more Providers.
3. Acceptance of terms
By accessing the Platform, browsing listings, using our tools or submitting a Quote Request, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.
You confirm that you are at least 18 years old and legally able to enter into a binding agreement.
4. Our role: marketplace and aggregator only
Business Setup AE is a comparison, discovery and lead-routing platform. We are not a company formation agent, law firm, licensing authority or government body.
Unless a specific service is expressly stated in writing to be provided by Business Setup AE, we do not incorporate companies, apply for trade licences, process visas, open bank accounts or file government submissions. Those services are provided by the Provider you choose, under a direct contract between you and that Provider.
We are not a party to any contract you enter into with a Provider and do not act as agent for either side of that contract.
5. Provider listings, package and pricing information
Listing information may originate from Provider submissions, Provider websites, or other publicly accessible sources. We may normalise, structure, summarise or reformat that information so packages can be compared consistently.
We do not guarantee that any Listing is complete, current or free of error. Availability, inclusions and eligibility conditions are determined by the Provider and by the relevant authority.
Listing information may include
- Company name and package name
- Price and price basis
- Services and inclusions stated by the Provider
- Visa allocation information
- Free zone, mainland or offshore jurisdiction information
- Publicly available business information
- Provider-submitted information
- Provider logos and trademarks, where the Provider has authorised their use
- Links to Provider websites
6. Third-party content and verification limits
Where we mark information as verified, that means we have checked it against the source available to us on the stated date. It is not a warranty of accuracy, suitability or continued availability.
You should independently verify the final price, availability, inclusions, government fees, visa eligibility, office requirements, activity requirements, taxes, approvals and any other applicable cost with the Provider before making any payment or commitment.
7. Pricing disclaimer
Prices shown on the Platform are indicative and may change without notice. A displayed price is not represented as a guaranteed final government or Provider price unless it has actually been verified as such and is stated to be fixed.
Final pricing may depend on
- Business activity and licence classification
- Jurisdiction, authority and free zone
- Visa quantity and type
- Office or workspace requirements
- Government and authority fees at the time of application
- Approvals and external clearances
- Shareholder nationality and business structure
- Other applicable regulatory requirements
8. Quote requests and Provider communications
When you submit a Quote Request, you authorise us to share the details of that request with the relevant Provider or Providers so they can contact you. Contact may be by phone, email, WhatsApp or other channel you have provided.
Any quotation, proposal, engagement letter or contract issued by a Provider is between you and that Provider. We are not responsible for its content, terms, pricing or performance.
9. Your responsibilities
- Provide accurate and complete information in Quote Requests and tool inputs
- Carry out your own due diligence on any Provider before engaging them
- Confirm final pricing, inclusions and eligibility directly with the Provider
- Comply with all applicable UAE laws and regulatory requirements for your activity
- Keep any account credentials confidential
- Not rely on Platform estimates as a substitute for professional legal, tax or regulatory advice
10. Provider responsibility
Providers remain solely responsible for their own services, package accuracy, pricing, availability, customer contracts, government submissions, licensing, approvals, refunds, service delivery and regulatory compliance.
Business Setup AE must not be represented as the service provider for any service that is actually delivered by a Provider.
11. No guarantee of approval or outcome
Government and authority decisions are outside our control. Unless expressly guaranteed in a separate written agreement, Business Setup AE does not guarantee:
- Company formation approval
- Trade licence approval
- Visa approval
- Bank account opening or approval
- Any government or authority approval
- Provider acceptance of your enquiry
- Exact processing time
- Exact final price
12. Payments and refunds
Business Setup AE does not charge Users for browsing packages, comparing offers, using the planning tools or submitting a Quote Request.
Payments for setup services are made directly to the Provider under that Provider's own payment and refund terms. Any refund of a Provider fee is a matter between you and the Provider.
Where Business Setup AE separately charges a Provider for advertising, featured placement, subscriptions or lead access, those commercial terms are set out in the applicable Provider agreement. Featured and sponsored placement is always labelled and does not alter the factual attributes shown for a Listing.
13. Provider content permissions
By submitting information, package details, pricing, logos or other materials to Business Setup AE, the Provider represents that it has the necessary rights and authority to provide that material and grants Business Setup AE a non-exclusive permission to display and use the material for marketplace, comparison, marketing and related platform purposes.
Providers must not submit content they are not entitled to share. If a rights holder believes material on the Platform has been used without authorisation, contact us and we will review and, where appropriate, remove or amend it.
14. Intellectual property
The Business Setup AE name, logo, page structure, original written content, tools, comparison frameworks and software are owned by or licensed to us and are protected by applicable law.
We do not claim ownership of Provider trademarks, logos, brand names or original Provider copy. Those remain the property of their respective owners and are displayed for identification and comparison purposes. Public availability of information does not imply unrestricted rights, and we use original structured summaries rather than reproducing substantial portions of third-party text.
You may not copy, scrape, republish or commercially reuse Platform content without our prior written consent.
15. Acceptable use and prohibited activities
- No automated scraping, crawling or bulk extraction of Listings without written consent
- No submission of false, misleading or fraudulent enquiries
- No attempt to bypass security, authentication or access controls
- No uploading of malware or interference with Platform availability
- No use of the Platform to send spam or unlawful marketing
- No misrepresentation of your identity or authority
- No unlawful, defamatory or infringing content
16. External websites
The Platform links to Provider websites and other third-party resources. We do not control and are not responsible for their content, availability, terms or data practices. Following such a link is at your own risk.
17. Disclaimer
The Platform, its content and its tools are provided on an "as is" and "as available" basis. Cost estimates, planners and eligibility tools are indicative aids and not formal quotations, legal advice, tax advice or regulatory determinations.
To the maximum extent permitted by applicable law, we exclude all implied warranties, including fitness for a particular purpose and uninterrupted availability.
18. Limitation of liability
To the maximum extent permitted by applicable law, Business Setup AE is not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, business opportunity or data, arising from your use of the Platform or from any dealing with a Provider.
Nothing in these Terms limits liability that cannot lawfully be limited.
19. Indemnity
You agree to indemnify Business Setup AE against claims, losses and reasonable costs arising from your breach of these Terms, your unlawful use of the Platform, or content or material you submit to us without the necessary rights.
20. Suspension and termination
We may suspend or terminate access to the Platform, or remove a Listing or account, where we reasonably believe these Terms have been breached, where content is inaccurate or unauthorised, or where required for legal, security or operational reasons.
21. Changes to these terms
We may update these Terms from time to time. The updated version takes effect when published on this page, and the Last updated date will change accordingly. Continued use of the Platform after publication constitutes acceptance of the revised Terms.
22. Governing law and jurisdiction
These Terms are governed by the laws of the United Arab Emirates and, where applicable, the laws of the Emirate of Dubai. The courts of Dubai, United Arab Emirates have jurisdiction over any dispute arising from these Terms or from use of the Platform, subject to any mandatory provisions of applicable law.
